Any vertical that has significant money to be made (insurance, banking, finance, etc.) will spawn black hat activity / sites. Legitimate companies that funnel money to lead gen and affiliates enable these bad actors to continue operating and profiting from their unethical (and sometimes illegal) activities.
Agreed. Black hats may have the upper hand initially, but I don't believe in it as a viable long term strategy because the game is always changing. AuthorRank and co-citation (Rand's WB Friday last week: http://www.seomoz.org/blog/prediction-anchor-text-is-dying-and-will-be-replaced-by-cocitation-whiteb...) will get really interesting from a "how to game this" point of view.
Also, I really think the ROI of being authentic, building an audience of people who love to hear what you say, and doing all the good healthy inbound marketing is rising more and more. Maybe blackhats will be left behind?
