Actually google is killing everyone who want to come-up, and not the actual spammers, they see any site that's coming up FAST, and they hit it, nothing brainy in that...
It would be interesting to know how often Google's own domains are automatically flagged for a manual check only to be immediately released due to the domain being theirs.
They should have to abide by their own rules otherwise it is no different to lawmakers and the police engaging in crime.
I see Google losing credibility further, not only do they seem to be giving the big brands more presence in the SERPs but they don't seem to follow their own rules, time will tell I guess.
Google shpould go fix their algo and stop bullying webmasters into changing their sites while themslevs they are above the law.
